Terms and Conditions for Purchase on the Online Shop

When a Customer orders products and uses services on the CMHK Online Shop of China Mobile Hong Kong Company Limited (hereinafter referred to as "CMHK"), it signifies that the Customer has agreed to comply with the following terms and conditions for the use of the CMHK Online Shop.

1.

Product Ordering

1.1

The Customer can submit an order and make payment through the following five steps:

(i) Put the product(s) into the Shopping Cart;;

(ii) Confirm the item(s) to be purchased;

(iii) Fill in the relevant online shopping forms;

(iv) Confirm the order; and

(v) Make payment online

(the above steps (i) to (v) are collectively referred to as the "Ordering Process"). Upon completion of the Ordering Process, the Customer shall not be able to change the contents of the order (e.g. type and quantity of product(s)), pickup and delivery information, and payment method.

1.2

The Customer must agree to the terms associated with the ordered product(s) and service(s).

1.3

The Customer shall be responsible for ensuring that all relevant data provided in submitting the order (which include, without limitation, personal information, delivery address, and contact details) is complete, updated, true and accurate. If CMHK fails to fulfill its responsibilities and/or obligations under this agreement or fails to fulfill them on time, or other circumstances occur due to the incomplete, not updated, inaccurate and/or misleading data submitted by the Customer during the Ordering Process, CMHK shall not be liable for the aforementioned failure to fulfill or delayed fulfillment of its responsibilities and/or obligations or the occurrence of other circumstances. The Customer hereby undertakes to indemnify and hold CMHK harmless against all costs, losses and damages resulting from the incomplete, not updated, inaccurate and/or misleading data submitted by the Customer during the Ordering Process.

1.4

The standalone handset products and related offers on the CMHK Online Shop are only available to the existing customers of CMHK.

1.5

For free gifts offered to handsets sold on the CMHK Online Shop, the color and style of those gifts will be allocated based on stock inventory. Where different types of free gifts are available, CMHK will make arrangements based on stock inventory. Once shipment was made, no request for change of free gift made by the Customer will be entertained.

1.6

Where the Customer's order fails to be transmitted to CMHK during the Ordering Process due to system network problem or other causes, CMHK shall not be held liable in any manner in that circumstance.

1.7

The Customer shall bear the risk that the color of the products photos as displayed on the CMHK Online Shop may differ from that of real products.

1.8

CMHK may sell or stop the sale of products on the CMHK Online Shop based on stock inventory without giving prior notice.
 

2.

Price and Payment

2.1

China Mobile Hong Kong Co., Ltd. (“CMHK”) reserves the right to adjust the prices of products and services listed on CMHK Online Shop (“Online Shop”) without prior notice from time to time.

2.2

The prices of products and services listed on Online Shop are settled in Hong Kong Dollars (“HKD”). Only HKD will be accepted for online payment.

2.3

Online Shop accepts payment made by designated Visa / MasterCard / JCB / UnionPay credit cards or UnionPay debit cards^, Alipay(real-name authentication by Mainland China ID card) or Octopus Online Payment Service+. Virtual credit cards are not accepted for online purchases.
 

2.4

By placing an order using one of the above credit/debit cards and online payment methods, customer confirms that the credit/debit card(s) or payment account used is owned by himself/herself or that has been authorized by the owner to use it.

2.5

If Customer’s credit/debit card is not denominated in Hong Kong Dollars (HKD), the final price charged will be calculated by its issuing bank in accordance with the applicable exchange rate on the day card issuer processes the transaction.

2.6

CMHK shall not be liable for any loss and damages arising directly or indirectly from the following:

(a) Customer’s personal data is exposed or accessed by a third party via other means when making online payment due to his/her negligence or omission; 

(b) Customer fails to provide complete, correct and accurate information during the online payment process;

(c) Any unauthorised payments and fraudulent transactions involved arising from the use of payment methods; or

(d) Any other problems arising from the specified payment method.

2.7

CMHK shall make all reasonable efforts to ensure price accuracy in terms of products and services listed on Online Shop and reserve the right to correct any errors at any time. In case of the existence of incorrect prices, CMHK reserves the right to reconfirm or cancel the order.
 

3.

Product Delivery

3.1

Different pickup and delivery services are available for products ordered on the CMHK Online Shop which include collection of the product by the Customer at CMHK's designated retail shops, or CMHK arranges hand delivery or mail delivery to the address within HKSAR as specified by the Customer. Pickup at CMHK's Designated Outlets

Handset, Accessory

  •  If you choose to pick up the handset or accessory product at CMHK store, generally you will receive SMS or Email pick up notice be able to pick up the product.
  • Once you go to the CMHK store to pick up the product, you must present your HKSAR ID card / passport, the original of the credit card (VISA / MasterCard) or UnionPay Online Pay (UnionPay Credit Cards/Debit Cards^) and the valid transaction payment record issued by the third-party payment platform(if applicable) that you used to make online payment.
  • CMHK service plan subscribers have to sign the handset contract (if applicable) in person to pick up the handset. Authorization for signing the contract is not allowed

Prepaid SIM, Refill Vouchers or Sim-Only Service

  • If you place order for Prepaid SIM , Refill Voucher or SIM-Only products and choose to pick up at CMHK store, you will NOT receive SMS or Email pick up notice and you can instantly proceed to the designated CMHK store for goods collection or service subscription after you have successfully placed the order.
  • When you go to the CMHK store to pick up Prepaid SIM or Refill Voucher products, you must present your HKSAR ID card / Passport, the original of Visa / MasterCard / JCB / UnionPay credit cards or UnionPay debit cards^ and the valid transaction payment record issued by the third-party payment platform(if applicable) that you used to make online payment. For SIM-Only service please bring your Identity Document, the original of the credit card (VISA / MasterCard) or UnionPay Online Pay(UnionPay Credit Cards/Debit Cards^) and the valid transaction payment record issued by the third-party payment platform(if applicable)  that you used in the payment, and valid "Proof of Address" to your designated CMHK shop within business hours in person to complete the subscription procedures (Please state to our staff that you have made the order in CMHK Online Shop).
     
  • If you cannot pick up the goods at CMHK shop in person, please download and fill in the authorization letter, and prepare the necessary documents to authorize a representative to do it for you. Before authorization so please note the following:

i) Authorized person must be at least 18 years old and must present his/her own HKID/Passport document original copy, and also provide this authorized letter original copy.

ii)  If the order has been paid online, authorized person must also present the copy of the front and back sides of the Visa / MasterCard / JCB / UnionPay credit cards or UnionPay debit cards^ used for online payment. Only goods of $20,000 or below are allowed to be picked up by authorised person for each visit. 

iii) CMHK do NOT accept authorization for tariff / other service subscription or signing additional supplementary agreement to pick up handsets or others goods at contract offer price.

iv) CMHK do NOT accept authorization for new / amend / cancel order request.

Delivery

Prepaid SIM, Refill Vouchers, Handset or Accessory

  • Generally, prepaid SIMs will be dispatched to the Customer via designated Courier Services or Hong Kong Post within 1-2 working days after order placement. The order of prepaid SIMs shall be deemed as completed when CMHK passes the prepaid SIM todesignated Courier Services or Hong Kong Post and no guarantee as to the delivery date will be given by CMHK. The actual delivery date will be subject to stock availability and delivery time.(We will send by ordinary mail if you only buy one 4G/3G Tourist Prepaid SIM Card4G/3G4G/3G Data & Voice Prepaid Card4G/3GSuper Talk Prepaid SIM Card or 4G/3GIndividual Traveler Prepaid SIM Card.)
  • žWhen you go to the CMHK store to pick up Prepaid SIM or Refill Voucher products, you must present your HKSAR ID card / Passport, the original of Visa / MasterCard / JCB / UnionPay credit cards or UnionPay debit cards^ and the valid transaction payment record issued by the third-party payment platform(if applicable) that you used to make online payment. For SIM-Only service please bring your Identity Document, the original of the credit card (VISA / MasterCard) or UnionPay Online Pay(UnionPay Credit Cards/Debit Cards^) and the valid transaction payment record issued by the third-party payment platform(if applicable)  that you used in the payment, and valid "Proof of Address" to your designated CMHK shop within business hours in person to complete the subscription procedures (Please state to our staff that you have made the order in CMHK Online Shop).

Sim-Only Service

  • Generally, prepaid SIMs or service plan contracts will be dispatched to the Customer via designated Courier Services within 1-2 working days after order placement. The contracts shall be returned to CMHK after signed by customer. The order of shall be deemed as completed when CMHK assessed and sent confirmation SMS.
  • žCustomer must ensure that read the full agreement, terms and conditions carefully before agrees to subscribe the Services.
  • For SIM-Only Service subscription customer shall receive the order or signed by designated recipient. CMHK do NOT accept authorization for tariff / other service subscription or signing additional supplementary agreement at any situation(s).
  • Courier might request you to present your HKSAR ID card / Passport, the original of Visa / MasterCard / JCB / UnionPay credit cards or UnionPay debit cards^ and the valid transaction payment record issued by the third-party payment platform(if applicable) which was used in the payment for verification. If customer cannot provide the above documents, CMHK reserves the right to refuse to provide the product.

 

Areas/ Time

  • Delivery Areas: Handset or SIM –Only delivery service is only available on permanent address of HKSAR (do not include P.O. Box Address ,Ma Wan,Chek Lap Kok(included Hong Kong International Airport),Hong Kong Disneyland,Discovery Bay,Ngong Ping 360,Cheung Chau,Lantau Island,Mui Wo,Tai O、Peng Chau,Lamma Island,Sha Tau Kok,Lok Ma Chau).
  • Delivery Time: Monday to Friday (9:00AM-6:00PM) and Saturday (9:00AM to 13:00 PM)
  • CMHK reserves the right to revise any terms of the delivery service (including but not limited to the covered areas for delivery and the delivery fee) from time to time without prior notice.
  • žDelivery service already scheduled shall be unavailable or delayed when typhoon signal No. 8 or above or when rainstorm warning signal black is hoisted. An alternative delivery service or HK Post service shall be arranged by CMHK.
  • Upon completion of the Ordering Process, CMHK will not accept any changes to the delivery method (delivery or pickup at store).
  • CMHK reserve the right to charge an additional delivery fee if the customer placed order with wrong delivery address or not available to accept delivery.

3.2

The Customer must collect the ordered product(s) and / or complete the relevant service subscription procedure(s) as required by CMHK at the designated CMHK shop within 14 days (unless CMHK otherwise specified a specific time limit) after completion of Ordering Process at CMHK Online Shop, failing which, CMHK is entitled to cancel the order. The Customer shall be deemed to have abandoned the ordered goods and/or service (‘the said Items”), and the CMHK is entitled to dispose the said Items in any manner it thinks fit without accountable to the Customer for any refund, or any loss and/or damages.

3.3

Credit assessment will be conducted in accordance with CMHK’s internal credit rating system at the time of ordered SIM-Only Service. If registrants’ account is in abnormal status; and/or has been cancelled; and/or has outstanding balance unsettled; and/or has poor records; and/or has problems relating to service plan status etc., registrants will not be qualified and not able to complete the subscription.

 

4.

Return and Exchange

4.1

The warranty for the workmanship and materials of handsets and accessories sold on the CMHK Online Shops will be provided to Customer in accordance with the terms and conditions specified by the respective manufacturer or vendor of the handsets or accessories from time to time. CMHK shall not be liable for any product-related liabilities that are caused by the manufacturer's error, negligence or omission. Under all circumstances, product liabilities shall be solely assumed by manufacturers.

4.2

For any problems of the handsets purchased on the CMHK Online Shop, the Customer shall bring along the online shopping and other relevant receipts to the CMHK Customer Centre or the designated Handset Suppliers' Repair Centres to replace or repair the handset. 4.3

The Customer may cancel or terminate service plans included in Handset & SIM, monthly service plans and prepaid SIMs purchased on the CMHK Online Shop in accordance with the relevant service agreements.

4.4

CMHK shall have the right to make final decision on the issues of quality of products and whether to exchange/return the product.
 

5.

Personal Data and Privacy Protection

5.1

CMHK will only use the Customer's personal data collected during the Customer's purchase on the CMHK Online Shop in ordering, registration, pickup and delivery services as requested by the Customer. Where necessary, CMHK will also send the Custome's personal data to Hong Kong Post or other delivery service companies to make delivery arrangements.

5.2

CMHK will keep Customer's personal data strictly confidential in accordance with requirements of the Personal Data (Privacy) Ordinance. For details on CMHK's Privacy Policy, please click here.

6.

Order Eligibility

6.1

In order to purchase on the CMHK Online Shop, the Customer must fulfill the following requirements:

a) be 18 or above (except for purchase of Prepaid Card) ;

b) Possess a valid Visa / MasterCard / JCB / UnionPay credit card or UnionPay debit card^ issued by a licensed bank,Alipay account(real-name authentication by Mainland China ID card), Octopus cards or O!ePay account that CMHK accepts as the payment method for purchases in the CMHK Online Shop (Customer's name must be the same as that of the lawful holder of the credit card/debit card/Alipay account/Octopus cards or O!ePay account);

c) ensure that the personal and payment data provided are valid and correct (including email address, real name, telephone number, billing information, and other information required by CMHK online platform).

7.

Intellectual Property Rights

7.1

All software and contents (defined here as any texts, audios, music, images, photos and pictures, or any contents containing the above) of CMHK are CMHK's intellectual property works and hence protected by intellectual property rights and copyrights laws and international conventions. The website of the CMHK Online Shop is for personal use only and not for commercial use. Contents of the website can be used for non-personal and/or non-commercial purposes only when the explicit authorization of CMHK and/or its third party licensor is obtained. Without the consent or authorization of CMHK, no contents of the website can be published, reproduced, sold or licensed. Any unauthorized act may result in civil liabilities or criminal sanctions.

7.2

CMHK reserves the right to revoke or modify any services from time to time without prior notice. If the website becomes unavailable for use at any time or a period of time for whatever reasons, CMHK shall in no circumstances be liable.

8.

Third-party Links

8.1

This website may contain links to websites or resources that are not managed or developed by CMHK. As CMHK has no control over such websites and resources, CMHK shall not be held liable for any losses, damages or claims as a result of or relating to the use of such websites or resources.

8.2

CMHK shall not be liable for any contents (and their accuracy) not belonging to this website which include but not be limited to those of advertisers. The Customer shall bear his/her own risks associated with the use of websites or resources linked from this website and shall be bound by the respective use and service provisions of such websites.
 

9.

Other Terms

9.1

CMHK will use its reasonable endeavours to ensure that the contents and product descriptions on the CMHK Online Shop are accurate and complete, but cannot guarantee that all the contents and product descriptions are accurate, complete, updated and error free. CMHK shall not be liable for any errors of information posted on the CMHK Online Shop. CMHK shall have the right to, from time to time, modify or correct any errors or omissions on the CMHK Online Shop or in any product sales materials, quotations, orders or other materials without incurring any liability.

9.2

CMHK shall not be held liable for any breach of contract which was directly or indirectly caused by any of the following reasons: acts of God, fire, flood, accident, riot, war, terrorist attack, government intervention, trade embargo, strike, labor dispute, equipment failure (including, without limitation, Internet access failure) or other factors beyond the reasonable control of CMHK.

9.3

Customers of the CMHK Online Shop agree to be bound by The (General) Contract for the Provision of Telecommunication Services and Purchase of Handset Terms and Conditions. For details, please click here.

9.4

CMHK does not guarantee that the use of this website and services is error free, or that servers of or providing support to this website do not contain viruses or other harmful items. CMHK advises all customers that use this website shall install on their own the latest version software including anti-virus software.

9.5

CMHK reserves the right to modify and revise all terms and conditions herein contained and the Privacy Policy from time to time without prior notice.

9.6

In case of disputes, the decision made by CMHK shall be final.

 

^UnionPay Credit Cards issued by banks in Mainland China and Overseas (including Hong Kong/Macau/other organizations) and UnionPay Debit Cards issued by banks in Mainland China are accepted for payment. For details of banks that support UnionPay Online Pay supporting banks, please click it.

+Octopus Payment Limits:
(i) For Octopus card and Octopus Mobile SIM, the payment limit is HK$1,000 per transaction and no daily transaction limit. 
(ii) For O! ePay, transaction amount is subject to the stored value limit and daily transaction limit of your O! ePay account. The limits are currently HK$3,000 for O! ePay Lite Accounts and HK$10,000 for O! ePay Plus and/or Pro Accounts.

After online payment is settled, customers should verify and record the details of the online payment record (if available) provided by the bank, ALIPAY, Octopus Online Payment Service+ or UnionPay Online Pay.
